MINUTES for May 20, 2006

 

 

Open meeting beginning at 11:00am at the Irish Beach Firehouse, 15401 Forest View Drive.

 

CALL TO ORDER

 

The meeting was called to order at approximately 1:00pm. 

IBADC members present:  Chuck Conner, Leon Drolet and Gordon Moores. 

Others in attendance:  Ward Carlisle, Kathryn Edelbrock, Annette Fromwiller, Francis Harrington, Jeff Hoy, William Moores, Ron Sackman, Steve & Suzanne Whitaker, Jim Wilbee and Bettye & Bob Winters.

 

Chuck introduced Leon Drolet who was appointed to the ADC by the IBIC Board of Directors on April 22, 2006.  Chuck also announced that he will be stepping down from the Committee after his term expires in July. 

 

APPROVE MINUTES/TREASURER’S REPORT

 

Approve minutes of 3/18/06 and 4/15/06:  Two comments were received from William Moores disputing the draft minutes of 3/18/06 in regard to Trout (2/19) Phase I and Ambrifi (7/34) Phase I.  One comment was received from Mr. Ambrifi’s architect, Richard Pate.  Chuck stated that the Committee feels the minutes of 3/18/06 are accurate and moved to approve them.  Gordon seconded and the motion passed 3-0.  The minutes of 4/15/06 were inadvertently not posted on the web site and approval will be postponed until the July meeting. 

Treasurer’s Report:  1/1/06-3/31/06, Fiscal Year 2005-06, 4/1/06 to date.  The ADC began the fiscal year with $4996.04 and ended with $250.54.  The ADC has taken out a $1000 loan from IBIC and currently has a cash balance of $1046.45.  Chuck moved to approve the treasurer’s report as submitted.  Leon seconded and the motion passed 3-0.  The reports will be available on the web site or by contacting the ADC secretary.

 

 

 

COMMUNICATIONS:

 

DUTRA 1/060 (14820 S. Hwy 1):  5/14/06  Notification of intent to replace the roof with Elk Prestique Plus 50 year roofing material in Sablewood color.  No permit is required.

 

HEINZER 1/067 (14861 Navarro Way):  3/30/06  Notification of intent to re-pave driveway.  No permit is required.

 

AZEVEDO 1/087 (14961 Navarro Way):  4/16/06  Receipt of letter stating intention to do various repairs.  No permit is required if the repairs do not change the dimensions of the deck.

 

GLASSBURN 1/106 (15251 Irish Beach Dr.):  4/8/06 Receipt of notification of intent to re-roof house.  No permit is required.

 

WHITAKER 4/11 (15461 Forest View Rd.):  4/15/06  Receipt of letter regarding an argument put forth by Gordon Moores during the ADC meeting of 4/15/06 regarding the right of a property owner to object to the creation of the view corridor by an upslope construction proposal.  (See minutes of 4/15/06-Hoffman 1/052).  This issue has been part of the discussion of the Hoffman application.  See “New Business: Hoffman” below.

 

UNFINISHED BUSINESS

 

PACKER 4/67 (15640  Forest View Rd):  Permit status.  The ADC received a letter on 4/4/06 and an email on 5/3/06 stating that construction has been delayed by 140 days due to saturated soil.  The time will be added to the permit and the expiration date recalculated.

 

HUNOLT 7/11 (44500 O’Rorey’s Place):   No reply has been received to ADC letter of 9/18/04 regarding excavation on property.  The Committee will seek legal council. 

 

GMEINER 7/23 (44370 O’Rorey’s Roost):  Permit status.  No response has been received from ADC letter dated 1/20/06. (See minutes 1/21/06)  The Committee will seek legal council.

 

TRATHEN 7/26 & 27 (44400 & 44410 O’Rorey’s Roost):  Issue of non-permitted split rail fence.  No response has been received to ADC letter dated 12/8/06. (See minutes 5/21/05 and 1/21/06)  The Committee will seek legal council.

 

TRATHEN 7/26 (44400 O’Rorey’s Roost):  Verification of foundation location and non-permitted construction of a fence or retaining wall.   No response has been received to ADC letter dated 12/8/05. (See minutes 1/21/06)  The Committee will seek legal council.

 

GMEINER 7/33 (44421 O’Rorey’s Roost):  Issue of trees.  (See minutes 1/21/06)  William Moores stated that he will submit the ADC Mediation Request form to begin the mediation process. 

 

NEW BUSINESS:

 

Hearings for New Home Construction and Major Exterior Modification permits will be limited to 60 minutes; 30 minutes for presentation and Committee questions and 30 minutes for audience input and discussion. 

 

HOFFMAN 1/052 (14780 S. Hwy 1):  (Cont. from 4/15/06) 4/22/06 Receipt of restated statement of understanding regarding the impact of future development on lots 1/070 & 071 on the view corridor of lot 1/052 per the 4/15/06 ADC meeting.  5/8/06 Receipt of notarized statement with Gardner (1/053) agreeing to a building envelope on 1/052 with a 6ft set back from the shared property line and also agreeing that any future expansion on lot 1/053 will maintain a minimum 22ft set back from the shared property line.  Neither the Hoffmans nor their designer, Paul Styskal, were present.  Chuck explained that the notarized agreement between Hoffman and Gardner will have to be attached to the deeds of both properties before a final construction permit will be issued so that future owners of the properties will be aware of the agreement.  He also explained that the Committee will no longer require a letter of understanding from Hoffman regarding the view impact of future development of lots 1/070 and 1/071 but instead will describe the primary view corridor on the construction permit.  Steve Whitaker said that there is no language in the CC&Rs that fits this requirement and stated his concern that it be described in the written procedures and be applied uniformly.  Chuck stated that the Committee will specify a view corridor when they approve a house, which is only repeating what is in the application. 

 

FROMWILLER 4/68 (15700 Forest View Road):  Minor Exterior Improvement permit application for the installation of a driveway apron.  No comments were received.  Annette Fromwiller was present and explained that the County may require a portion of the driveway to be wider than originally proposed.  Chuck moved to approve the application subject to the County requirement.  Leon seconded and the motion passed 3-0.

 

MOULTHROP 4/60 (15470 Forest View Dr.):  Minor Exterior Improvement permit application for the installation of a driveway and garbage enclosure.  The driveway has already been installed.  No comments were received.  The Moulthrops were not present.  Chuck explained that Committee members are concerned that the large size of the driveway will essentially make it a parking lot, particularly since it is a vacation rental.  In addition, the proposed garbage enclosure is not large enough to accommodate a recycling bin and the submitted drawing is not accurate..  The Moulthrops must submit a new application which either reduces the size of the driveway or provides screening for the cars that will inevitably be parked there.  The garbage enclosure must be able to fit 2 garbage cans and a County recycling bin and the dimensions and location must be accurately shown.  The Committee approved the proposed accent color. 

 

SACKMAN 7/14 (44280 O’Rorey’s Roost):  Phase II application for New Home Construction permit.  A comment was received from Lawrence Moglia (7/13) questioning the accuracy of the stakes.  An additional comment was received from Moglia objecting to the placement of the garage.  Mr. Sackman has replied to the objection in writing.  Richard Sackman and Francis Harrington, his architect, were present.  During a site visit prior to the meeting, the Committee members observed that construction has begun with the installation of the septic system.  Mr. Sackman stated that he had not understood that this was not allowed and agreed to stop all construction except to back fill the hole for safety reasons.  The Committee also observed that because of the construction, some of the property line and building envelope stakes have been removed, making it impossible to address Mr. Moglia’s concerns about their accurate placement.  Mr. Ambrifi stated that Dave Paoli had checked the property line stakes.  In response to a question from Leon Drolet, Mr. Harrington stated that he can mitigate potential problem of water drainage on the driveway and will show it in the construction drawings.  Chuck explained that the Phase II application cannot be reviewed today because it was not staked completely, making it impossible for the Committee members to clearly see what is being proposed.  The project must be re-staked and will be placed on the July agenda.

 

AMBRIFI 7/34 (44301 O’ Rorey’s Roost):  Phase II application for New Home Construction permit with an east set back variance.  Neither Mr. Ambrifi nor his architect was present.  Chuck explained that Mr. Ambrifi can either use the approved Phase I building envelope or go through the variance process.  Bill Moores, potential future owner of lot 35, stated that he does not object to the set back variance if Ambrifi will hip the east roof and restrict the south border of the building envelope to no further than 71ft from the northeast corner of the property.  The Committee needs color samples of the roof and siding.  No action was taken.

Chuck moved to adjourn the meeting at 12:35pm.  Leon seconded and the motion passed.
