CALL TO ORDER:

 

The meeting was called to order at approximately 1:10 PM at the Irish Beach Firehouse, 15401 Forest View Drive.

 

IBADC Board members present:  Chairman Jim Day, Directors Gordon Moores, Nik Epanchin and Chuck Conner.  Secretary/Treasurer:  Pam Knutson.

TREASURER’S REPORT:

 

The Treasurer’s Report, covering April 1 – June 30, 2004, was presented by Pam Knutson.  There was no discussion on the report.

 

NEW BUSINESS:

 

COOK  1/031 (14840 Navarro Way):  Minor Exterior Permit Application to install lower deck and stairs.

Builder Jim Deering represented the Cooks proposed new deck and stairs.  Chairman Jim Day stated that to date, two letters had been received, from neighbors the Levinson-Palmers (1/032) and the Thompsons (1/030).  The first requested IBADC to delay its decision until the Levinson-Palmers had an opportunity to visit Irish Beach and evaluate the impact of the proposed improvement on their view corridor.  The second requested that IBADC disapprove the project because it will intrude into their privacy.  Jim Deering stated that he was authorized to pay the Thompsons for new window coverings to maintain their privacy.  The Thompsons refused, requesting IBADC to ask the Cooks why this project was being considered and why not plan it in a different manner, without intrusions into the Thompson’s private dining area.  After further discussion, a motion was made to table the application and request the Cooks to explain why this particular improvement was requested when other options more amenable to neighbors existed.  The motion passed 4-0.

 

PASQUALETTI  4/17 (15575 Forest View Road):  Minor Exterior Permit Application to install tool shed.

Russ Pasqualetti presented the proposed tool shed location.  Chairman Day stated that the only comment received was an objection from the Powers family on a fax dated 11/15/2003.  After lengthy discussions, a motion was made to allow Russ Pasqualetti to place the shed in either of two locations (as presented or closer to Forest View Drive, above his leach field) after he discusses the matter and reaches accord with the Powers family and advises IBADC of the outcome.  The motion passed 4-0.

 

EPANCHIN  4/35 (15721 Forest View Road):  Major Exterior Modification Permit Application.

Nik Epanchin presented the proposed expansion with a footprint of 800 ft2, noting that both the building envelope and the perimeter of the addition have been staked for at least three weeks.  He explained that current IBADC building procedures for Major Exterior Modification required but a single IBADC public meeting.  If there are public objections, then a second public meeting may be required.  Chairman Day noted that two letters had been received regarding this expansion: a favorable comment from Mr. Jay Schmuecker (4/33) and one questioning details of the proposal from Ms. Annette Fromwiller (4/68).  Ms. Fromwiller, who was in the audience, said that Nik Epanchin answered all her questions and she had no objections to start with.  Board member Gordon Moores objected that no view corridor study had been done.  Nik Epanchin showed that indeed a study had been done and was included in the Epanchin submittal of which IBADC mailed more than 25 copies to the various neighbors.

Since none of the voting IBADC members had visited the site, the Board decided to approve the expansion as presented pending final okay after a site visit immediately after the meeting.  The motion passed 3-0.

Nancy Epanchin requested that the minutes indicate that Nik Epanchin had recused himself from all IBADC deliberations.

 

COMMUNICATIONS:

 

RAPELJE  1/003 (15400 South Highway One):  Reply to IBADC letter of May 26, 2004 requesting removal of story poles (6/25/04).  Mr. Rapelje wrote IBADC requesting that no one remove his story poles, as they were needed to represent his proposed home for other entities involved in the permitting process, i.e. Caltrans, the Coastal Commission, etc.  Mr. Rapelje is coming to the area in August; IBADC will try to schedule a meeting with him then.

 

MOORES, GORDON  1/095 (44001 Noyo Way):  Letter requesting change in placement of stairs on remodel of Real Estate Office due to Court Order (7/10/04).

The committee stated that Gordon had never properly applied for a permit, and that he was required to do so now, since the project involved more than just repair and replacing in kind of the old deck.  Mr. Moores was instructed to pay the balance of the $150 fee, of which he had already paid $25.  Gordon is also planning a deck extension to the new deck, for which he will apply for a separate permit.

 

ROSS  3/08 (14680 Cypress Point Road):  Received copy of final construction drawings (7/13/04).

The committee approved the Ross’ final plans.  Their permit will be issued as soon as signed drawings are returned to IBADC.

 

GMEINER  7/23 (44370 O’Rorey’s Roost):  Sent copy of Coastal Development Permit (7/12/04).

 

THOMPSON  1/030 (14860 Navarro Way):  Letter advising replacement of rotten wooden steps with pavers and cement blocks, and to add a hand rail (7/11/04).

 

WHITAKER  4/16 (15461 Forest View Drive):  Letter advising removal of large tree encroaching upon their septic tank (6/25/04).

 

 

UNRESOLVED ITEMS:

 

KUCALA  2/47  (14950 Mallo Pass Drive):  Deck modified without IBADC permit (IBADC sent Kucalas a letter dated July 10, 2004).

HUNOLT  7/11  (44500 O’Rorey’s Place):  Grading and excavation on Irish Beach property without IBADC permit (IBADC sent Hunolt a letter dated July 12, 2004).

 

Jim Day announced that a new committee member would soon be appointed.

 

Before adjournment, Chairman Day asked if there was any other business.  Alex Corey (Unit 3, Lot 10) stood up and spoke.  His Phase I submittal had been rejected by the committee because he was using building designer Paul Styskal and not a licensed architect.  Mr. Corey asked the committee to reconsider its decision, since both the CC&Rs and the Irish Beach Building Procedures include designers in their definition of who can submit a proposal.  A debate ensued around interpretation of the term “Professional Architectural Designer.”  Gordon Moores, who was one of the authors/reviewers of the CC&Rs, said that it was intended to mean a designer who was licensed to practice by the AIA, but Al Thompson, who also participated in the final reviews of the CC&Rs, said it only meant to distinguish a building designer from other types of designers.  There is no such thing as a licensed architectural designer.  Paul Styskal was present and outlined his qualifications to the committee.  He also stated that 3 licensed professionals inspected and signed off on every set of plans that he presents: a structural engineer, a surveyor and an environmental health specialist. 

Another discussion ensued regarding IBADC’s right to create Building Procedures, which in effect changes the CC&Rs.  Committee member Nik Epanchin explained that indeed the CC&Rs had provisions that he could not quote that instant but which granted IBADC the power to create Building Procedures as well as expand requirements set forth in the CC&Rs.

Finally, three of the four committee members agreed that Mr. Corey’s submittal should indeed be heard at the next meeting.  Jim Day apologized for any inconvenience to Mr. Corey.

 

It was motioned, seconded, and unanimously approved to adjourn the meeting at 2:50 PM.

 

Note:  after the meeting the committee visited the Epanchins’ proposed building site.  After review, they approved 3-0 a provisional permit pending receipt, review and approval of the septic permit and final building plans.
