called the meeting to order at approximately 10:07AM. He
introduced Committee members John McGehee and Walt Salmen. A quorum was
present. Leon Drolet and Gordon Moores
were absent.

NEW
BUSINESS:
Hearings for
New Home Construction and Major Exterior Modification permits will be limited
to 45 minutes; 15 minutes for presentation and Committee questions and 30
minutes for audience input and discussion.
RAPELJE 1/003 (15400 S. Hwy 1): Revised New Home Construction Phase II
application with a height variance request.
One comment was received from William Moores (2/03). Architect Debra Lennox presented the
application. She explained that this is
a revision of a previously approved house, which had a height variance of
3’6”. They are now requesting a height
variance of 2’0”. The size of the house
has been downsized from approximately 3000ft2 to 1200ft2 due to requirements related to the septic
system and financial consideration. The
septic system design required moving the location of the house and changing the
foundation from slab on grade to a crawl space design, which raised the floor
level. The house is still located within
the approved building envelope. The
proposed house has a 5:12
roof pitch, which is preferred when using interior trusses. She also explained that they plan to build
the house in three phases, with the current proposal being the first
phase. A garage and an expansion of the
house will comprise the next phases.
County approval is conditioned on the results of the final Point Arena
Mountain Beaver study and approval of the septic system. Nik stated that
variances are granted based on hardship and that a variance request letter is
essential to explain the hardships. He
suggested that the garage be included in this proposal in order to raise the
mean natural grade and thereby lessen the height variance. The garage does not have to be built at this
time, but approval now will eliminate the need for an application hearing in
the future. The current design includes
screened parking. Ms. Lennox agreed to
the proposal. Nik
moved to approve the application pending receipt of a detailed backup letter
enumerating and explaining all the hardships involved. At a minimum, this
letter is to address a)the septic system changes which
are forcing them to raise the floor from elevation x to y, b)explain why 5:12
roof pitch is deemed appropriate at this time in order to accommodate the
future expansion, c)incorporate the garage into this Phase II if it will raise
the mean natural grade, and d)indicate by dotted line on a site plan the
possible future expansion(s). Walt
seconded and the motion passed 3-0. The
variance letter will be mailed to neighbors and a 30-day comment period will be
observed. If no objections are raised, Rapelje will already have approval for the garage and will
only have to pay the fee for a Major Exterior Modification permit.
MOGLIA 7/13 (44515 O’Rorey’s Roost): Minor Exterior Improvement permit application
for a deck. No negative
comments were received. Walt moved to
approve the application. John seconded
and the motion passed 3-0.
COMMUNICATIONS:
TILLER 1/014 (15150 Irish Beach Dr.): 7/10/08 Receipt of final
construction drawings for Major Exterior Modification permit 0707-1014. The plans were reviewed
and approved.
McCormick 1/029 (14870 Navarro Way): 6/2/08
ADC letter explaining that
the flat roof variance is on hold until connecting tape is installed on the
story poles. The McCormicks informed the Committee that the County may
require changes to the house and will wait for their decision before
reinstalling the story poles and continuing the variance process
SUMNER 1/047 (Navarro Way):
6/21/08 The Sumners submitted a Phase I
application for a New Home Construction permit but withdrew it due to septic
permit issues.
CONNER 1/063 (44000 Noyo Way): 6/10/08 Receipt of location
verification for Major Exterior Modification permit 1005-1063.
SCHEAFFER 2/21 (44641 Pomo Lake Dr.): 5/20/08 Receipt of final
construction drawings for New Home Construction permit 0307-0221. The Committee did not approve the drawings
and replied to the Scheaffers in writing on 5/30/08. The Scheaffers
submitted an incomplete set of revised drawings on 6/13/08 with a request to waive the
requirement that drawings be done by a licensed architect or approved
professional architectural designer. The Scheaffers
now have a new architect, Lyndon Ernst, who will submit new drawings. The ADC
rejected the proposal to add an outside stairway to access the upper deck
because it would encroach into the 14ft east setback. In addition to providing a corrected site
plan and the four new elevation views, Lyndon Ernst, who has visited the site
will attached an architect’s statement and a detail of the new interior access
to the deck over the garage.
HUMPHIES/HYMANS 2/45 (15000 Mallo Pass Dr.): 7/10/08 Notification of
plans to replace some of the windows and siding and to re-stain the house with
no color change.
POTT 2/66 (15125 Mallo Pass Rd.): 6/2/08 Notification of their
plans to paint the house and replace the deck with no change in size or
dimensions. Color samples were submitted
and approved.
WOLFE 3/39 (43600 Sea Cypress Dr.): 5/22/08 Receipt of
final construction drawings for Major Exterior Modification permit
0308-0339. The plans are approved.
LIMBERG/WHITNEY 4/72 (15780
Forest View Court): 6/3/08 Receipt of final construction drawings for New Home
Construction permit 0108-0472. The plans
are approved. 7/2/08 Notification that
construction will begin on 7/7/08.
MOORE 7/09 (44520 O’Rorey’s Place): 7/17/08 Dan and Marsha Moore
have requested the addition of eaves beyond what was approved for the garage,
which is currently under construction. The
Committee members made a field trip at the end of the meeting to review the
request and concluded that the addition of eaves would be an aesthetic
improvement and will probably have minimal impact on views. The ADC
will ask Mr. Moore to place 2x4s out to the length of the proposed eaves and
connect them with tape so the impact can be seen and then to take pictures from
the houses that may realize a view impact.
(Mr. Moore subsequently submitted pictures from lots 7/13-16, 7/20,
7/23, 7/27, 7/28 and 7/34. In addition,
he submitted signed statements of non-objection from Moglia
(7/13) and Sackman (7/14). The Committee concluded there will not be any
material view impact and approved the addition of eaves to the north and east
sides of the garage.)
SACKMAN 7/14 (44280 O’Rorey’s Roost): 7/14/08 Receipt of update on construction
status. The Sackmans are trying to get a completion date from their
contractor and will need a permit extension.
UNFINISHED BUSINESS
FREIS 1/015 (15120 Irish Beach Dr.): Receipt of a
letter from William Moores stating that an
non-permitted storage shed has been constructed. The Committee sent letter of inquiry to the Fries on
5/30/08. The Fries responded on 6/11/08 stating that the garbage and
propane tank enclosure was rebuilt in the same location after being damaged
last December.
survivor trust 1/059 (14800 S. Hwy 1): The IBADC
wrote a second letter to Cal Fire on 3/31/08 requesting them to inspect the abandon property
for fire hazards and to take appropriate action. Cal Fire responded on 4/4/08 stating that a Defensible Space
inspection was done and the results sent to the property owner. Follow-up inspections will also be done.
GMEINER 7/23 (44370 O’Rorey’s Roost): 4/7/08 Receipt of a letter regarding
construction delays for permit 0702-0723. Mr. Gmeiner has not
yet detailed the delays he may have encountered during construction.
OWNER/BUILDERS: The IBADC has asked several owner/builders in
Irish Beach to comment on how to handle
owner/builders who intend to take much longer to complete exterior construction
than presently handled by the CC&Rs and procedures. (See minutes of 3/17/07 and 5/19/07.)
