CALL TO ORDER:
The meeting was called to
order at 1:00pm at the Irish Beach Firehouse, 15401 Forest View Drive.
IBADC Board member
present: Chairman Jim Day, Directors Jim Albert, Chuck Conner
and Gordon Moores. Absent was Director
Nik Epanchin.
Others in attendance: Marty and
Cindi Moreali, Glenn Coleman, Susan Hemmenway, Keith Laderoute, Dorothy Engle,
Cathy and Alex Corey, Su and Steve Whitaker, RJ Dial, Bettye Winters, Paul
Styskal, Joel and Patricia Kauffman, Al and Loretta Thompson, Paul Lagergren,
Paul Menard.
Approval of Minutes: The
minutes of the July 17th, 2004 meeting were approved with the
following correction: under “Communications: Whitaker”, “septic tank” is changed to
“shed”.
NEW BUSINESS:
LAGERGREN 4/53 (15300 Forest View Road): Phase II
building permit application for new home construction (with variance
request). Architect Paul Menard represented th Lagergren
proposed new home with a variance request for an area of flat roof to be used
as an observation deck. Menard stated
that while the application has been made as a variance, it could be argued that
none is needed because all height restrictions have been met. Jim Day stated that flat roofs are a
variance and must be included as such in applications. IBADC expressed concern that in the future
the flat roof area may be used as a balcony with screening materials added. Menard stated that nothing would be added to
the parapet in the future. In response
to a question, Menard explained that the flat portion of the roof would drain
into gutters and then into the properties drainage system. Gordon Moores noted that the flat roof does
not violate height restrictions and is aesthetically pleasing. No correspondence has been received
objecting to the submittal or the variance request. Gordon Moores motioned to accept the variance. The motion was seconded and passed 4-0. Chuck Conner motioned to approve the Phase
II submittal. The motion was seconded
and passed 4-0.
COREY 3/10 (14640 Cypress Point Road): Phase I
building permit application for new home construction.
Designer Paul Styskal
presented the site plan for the Coreys.
The plans show placement of the house on the north end of the lot with a
6’ setback from lot 11 to the east and the leach field on the south end of the
property. Styskal stated that due to
soil and slope, a house on lot 11 would be placed on the south or front end of
the property and there are no view issues.
Jim Day stated that it has been assumed the neighbor will accept the 6’
setback. The owner of lot 11, Gordon
Moores, was present and disagreed with the assessment, stating that Corey’s
house should be moved west to provide a 16’ setback. Alex Corey stated that because the house on lot 9, to the west,
is only 10’ from the lot line, he must place his house further east to comply
with the requirement of 32’ between eaves.
A lengthy discussion followed regarding the correct interpretation of
the CC&R’s pertaining to setbacks and the implications of existing
structures that do not meet the set back requirements on future
structures. The Corey’s argued that the
CC&Rs only require a 6’ setback on side yards, which applies to the east
side of his lot. He also argued that
the 16’ set back requirement does not apply to vacant lots. IBADC argued the 6’ setback is only a
minimum requirement to be considered with all other factors including view
corridors and the 32’ eave to eave requirement. Su Whitaker stated that inadequate setbacks on existing
structures should be considered when reviewing proposed structures. The Corey’s noted that many houses in Irish
Beach have only 6’ set backs and ask why a 16’ set back is now required. Others, including IBADC, argued that dealing
with such situations by creating a domino affect of inadequate set backs serves
to perpetuate the problem, not solve it.
Styskal asked IBADC to grant a variance for the set backs on the east
and west sides of the lot. IBADC
strongly urged the Coreys to contact their neighbors in lots 9 and 11 and first
attempt to work out a compromise. Jim
Day stated that it is within the jurisdiction of the IBADC to grant a variance
allowing the Coreys to move the building

site west and that the
comments of neighbors are paramount but not absolute. A motion was made to approve the Coreys Phase I plans as
submitted with the stipulation that written approval from the neighbors must be
obtained for the building location. The
motion was seconded and passed 3-0.
Gordon Moores abstained.
HEMENWAY-LADEROUTE 4/03 (15301 Forest View Road): Phase I
building permit application for new home construction. Keith
Laderoute presented the Phase I submittal for new home construction. He explained that this is a new submittal in
which the size of the building and
leach field has been reduced. He stated
there are no view corridor issues. Jim
Day complimented Mr. Laderoute on his narrative and expressed appreciation that
he has shown the location of trees on his property. Chuck Conner asked about the smaller septic system. Mr. Laderoute explained that is it being
designed by a septic engineer utilizing technology which allows for a smaller
system. Jim Albert moved to approve
Laderoute’s Phase I submittal. The
motion was seconded and passed 4-0. The
Laderoute-Hemmenways asked if they are required to resubmit the permit
fee. IBADC replied in the affirmative.
COMMUNICATIONS:
IRISH BEACH WATER
DISTICT: Formal resolution concerning the use of the
Irish Beach firehouse for public meetings (7/24/04). The firehouse may be
used for public, community meetings within stated guidelines. It was explained that a formal resolution
was required for insurance liability reasons.
ROSE 1/098 (15101 Irish Beach Drive): Received
redlined final construction drawings (7/25/04). The Rose plans have
been signed and a permit issued.
CADY 2/53 (43850 Acquistapace Road): Advised of
re-staining house in same color (8/4/04). IBADC acknowledged in writing
the letter of 8/4/04 regarding re-staining with no color change.
PRENTICE 3/20 (14771 Cypress Point Road): Advised of
re-staining house in similar color (7/17/04). IBADC acknowledged in writing
the letter of 7/17/04 regarding re-staining with no color change.
DIAL 3/31 (14751 Alta
Mesa Road): Request for
temporary variance to park a travel trailer on property during burn
season. (8/2/04) A
letter will be sent informing the Dials of the denial of their variance
request.
PASQUALETTI 4/17 (15575
Forest View Road): Email advising accord reached with neighbor
regarding placement of tool shed (7/22/04).
There were no comments. A minor construction permit has been issued.
POEHLMANN 4/26 ( Forest View Road): Advised of
residing with same materials, and permit application to install new window
(7/5/04). IBADC acknowledged Poehlmann’s letter and has replied in writing
that there are no further requirements regarding the siding replacement. A permit has been issued and sent to the
Poehlmanns for the window addition.
MORTON 4/42-43 (Forest View Road): Advised of
necessity of moving fireplace location in new home (7/11/04). The movement of the chimney was found to be
immaterial. IBADC will send written
notification to the Mortons.
UNRESOLVED ITEMS:
KUCALA 2/47
(14950 Mallo Pass Drive): Deck
modified without IBADC permit (Kucalas submitted reply to IBADC letter of
7/10/04 and permit application on 8/7/04).
Mr. Kucala submitted a copy of a letter to him from IBADC dated July of
2003 stating that he did not need a permit for his deck. Jim Day asked if changes in the deck had
been described. Mr. Kucala stated the deck has been moved up
10” and a solid railing added along the top.
The Kucala application will be heard at the September meeting.

HUNOLT 7/11
(44500 O’Rorey’s Place): Grading
and excavation on Irish Beach property without IBADC permit (IBADC sent
Hunolt a certified letter dated 7/12/04, letter was returned refused
7/22/04). IBADC will have the letter to
Mr. Hunolt professionally served.
MOREALI 2/12 (44801
Pomo Lake Drive): Marty and Cindi Moreali asked why they were
not on the agenda for their Phase II submittal. IBADC, realizing its error, apologized and explained that this
seems to have been a result of the change over in secretaries as well as some
problems with the submission. A list of
the problems was given to the Moreali’s and their architect, Glen Coleman for
review. Mr Coleman stated that most of
the problems are technical and easily addressed. It was also determined that the Moreali’s need to apply for a
variance for a proposed area of flat roof to be used as an observation deck. To mitigate IBADC’s error, it was agreed
that the Moreali Phase II submittal and variance request will be immediately
mailed to neighbors and will be placed on the September agenda with the
understanding that 30 days must be allowed for comments on the variance
request. Architect Glen Coleman briefly
presented the building plans showing the location of the house in relation to
future neighbors. He stated his
neighbor, Traversa (2/11) has agreed allow a 6’ set back and that neighbors
will be able to see over the house to the view. The house will have redwood or cedar siding, a black roof, and
white or almond windows sashes.
ADJOURNMENT: A motion was
made to adjourn the meeting at 3:12pm.
The motion passed unanimously.
