MINUTES for October 1, 2005

 

 

Open meeting beginning at 11:00am at the Irish Beach Firehouse, 15401 Forest View Drive.

 

CALL TO ORDER

Nik Epanchin chaired the meeting in the absence of Chuck Conner.  He called the meeting to order at 11:10am.

 

IBADC members present:  Jim Albert, Nik Epanchin, Gordon Moores and Walt Rush.  Chuck Conner was absent.

APPROVE MINUTES:

Walt moved to approve the July 23, 2005 minutes.  Jim seconded and the motion passed 4-0.

NEW BUSINESS:

 

TREASURER’S REPORT:  July 1, 2005-September 30, 2005  The IBADC funds as of July 1, 2005 were $4574.99.  Income received totaled $1966.50, expenses were $2748.94 leaving a balance of $3792.55 as of September 30, 2005.  Walt moved to approve the treasurer’s report.  Jim seconded the motion and it was passed 4-0.

 

WM. MOORES 7/15 (44290 O’Rorey’s’ Roost):   Phase I application for New Home Construction permit continued from July 23, 2005.   Mr. Moores has indicated orally that he is no longer requesting a rear yard variance and has provided a notarized statement as the future owner of lot 16 agreeing to the proposed north side yard set back variance.  An email was received from Anders/Lemos (7/29), who are currently abroad, requesting the Committee to check that the proposed construction will not block their ocean view.  Nik stated that the Committee understands that it is likely that Bill Moores will be the future owner of lot 16 although the transfer process is not complete.  Nik also stated his understanding that the building envelope will no longer be pushed westward toward the Moglias’ house (7/13) and that the 32ft eave to eave separation will be maintained.  Bill confirmed that he is no longer requesting a variance to the 20ft rear yard set back.  It was agreed that the existing drawings will be redlined to reflect the changes.  The Committee addressed other concerns raised by Lawrence Moglia (7/13) in his letter dated 9/29/05.  Bill confirmed that he intends to disperse the water on site.  Mr. Moglia’s concern about the placement of decks close to his house is most appropriately addressed in the Phase II application hearing.  Nik explained that while it seems likely that Bill Moores will be the new owner of unit 7 lot 16, the process of transferring the property is not complete and the ADC can only deal with the owner of record.  He stated that, in his opinion, the Phase I application is okay, however the Committee still needs a notarized letter from Bill, as the owner of lot 16, stating that he will allow the owner of lot 15 to be 6ft from its north boundary and therefore construction on lot 16 will never be less than 26ft from its south boundary.  Nik proposed granting a provisional Phase I approval that will take affect when the transfer of ownership of lot 16 is validated and a notarized letter is received stating that William Moores is the owner of lot 16 and does not object to a 6ft set back on lot 15.  Walt moved to approve the Phase I application as described.  Jim seconded and the motion passed 3-0 with Gordon Moores abstaining.  Bill Moores and the Committee then reviewed his Phase I drawings and agreed on the location of the revised building envelope. Bill Moores red lined, signed and dated the revisions. 

 

LISTER 3/64 (43651 Sea Cypress Dr.):  Minor Exterior Improvement permit application for the construction of a deck and after the fact permit for a shed.  Nik said that he thinks the proposed deck looks reasonable.  It was confirmed that both projects were submitted as one application.  The application was mailed to the appropriate neighbors and no objections were received.  Gordon moved to approve the shed as it exists and the deck as proposed.  Walt seconded and the motion passed 4-0.

 

SACKMAN 7/14 (44280 O’Rorey’s Roost):  Phase I application for New Home Construction permit.  A letter was received from Moglia (7/13) regarding the accuracy of Mr. Sackman’s drawings in regard to drainage.  Mr. Moglia has spoken with the project architect about his concerns.  Mr. Francis Harrington, Architect, presented the application.  Nik asked if Lawrence Moglia’s (7/13) drainage concerns have been resolved.  Mr. Harrington explained that the plan is to place the driveway parallel with the driveway on lot 13 and direct water run off down the driveway and into the County drainage ditch.  He stated that Mr. Moglia is in agreement with the plan.  No other comments were received or made at the meeting.  Nik moved to approved the Phase I application as submitted with the understanding that drainage will be directed to O’Rorey’s Roost.  Walt seconded the motion and it passed 4-0.  Nik stated that an email was received from Lehmans/Anders, the owners of unit 7 lot 29 who are abroad, requesting that the effect of any proposed construction on their blue water view be considered.  (The email actually refers to lot 15.)  The Committee believes that proposed construction on lots 14 and 15 will not impact the blue water view from lot 29.  Mr. Harrington agreed to specifically address their concern in the Phase II application. 

 

HARLEY 4/63 (15550 Forest View Drive):   Phase II application for New Home Construction permit.  David Paoli presented the application.  He explained that all set backs comply with the CC&Rs.  The revised plans show that the driveway was moved further from the living area of DeCaminada (4/62).  Nik stated that the mean natural grade elevation must be shown on the approved drawings and can be added at this time.  In response to a question, Mr. Paoli stated that the owners intend to place garbage cans inside the garage.  Nik explained that any future sheds will require a permit and suggested that shed locations be redlined on the Phase II drawings now and included in the final drawings.  Mr. Paoli explained that the proposed house will be 18ft 4in above mean natural grade with a 4:12 roof pitch.  The garage will be lower in elevation.  The siding is cedar plank with silver gray weathering stain and the trim is light sand or almond.  The windows will not be white.  The proposed deck is under 30in in height and therefore does not require a railing.  Nik stated that all exterior lighting must be downcast and shielded.  He explained that a provisional permit is not a final construction permit.  A final permit is issued when final construction drawings relating to the foundation location, building height and exterior appearance are received and approved.  The drawings must be signed and dated by the property owner(s).  Nik further explained that the applicants are responsible for providing the Committee with the name, address and phone number of a contact person for the project.  Before pouring concrete, the Committee must receive written verification that the foundation location conforms to the approved Phase II application.  Before the top plates are placed, the Committee must received written verification that the building height conforms to the approved Phase II application.  The verifications must be made by an appropriately credentialed professional.  Gordon stated that an email was received from Ginny and Gary Heitz (3/56) expressing concern about the impact of the proposed house on their ocean view.  Nik stated that the Committee visited the Heitz property prior to the meeting and do not think that the proposed project will impact the view from lot 56.  Suzanne Whitaker stated that she likes the style of the house and thinks it is a beautiful design for the space.  Walt moved to approve the application with the corrected mean natural grade elevations.  Jim seconded and the motion passed 4-0. 

 

HARPER 3/46 (43661 Cypress Parkway):  Phase II application for New Home Construction permit.  Robert Harper presented the application.  He explained that he revised the previous Phase II application by swapping the septic system from the front to the back and pushing the house to the 20ft County set back.  This was done at the suggestion of his neighbors, Seaman (3/45), and MCP and gives Seaman 100% of his ocean view to the west.  Subsequent tree work has also opened up the view to the south.  Nik stated that the revised building envelope will have to be red lined on the existing drawings so that the correct envelope is on record.  Mr. Harper explained that he no longer proposes to use the drainage easement on the property or install a French drain.  The lot slopes from north to south and water will continue to drain naturally into the “winter pond”.  Nik asked for an explanation of the “special conditions” noted on the County septic permit.  Mr. Harper said he was unaware of any special conditions will get clarification from the County.  Nik noted a minor math error that results in a maximum height of 117.75ft, not 116ft as indicated on the worksheet .  The building is still below the 20ft height limit.  Mr. Harper stated that the colors were approved at a previous hearing.  The siding is Hardie plank in medium gray with no trim.  The windows will not be white.  Nik stated that all exterior lighting must be downcast and shielded.  He explained that a provisional permit is not a final construction permit.  A final permit is issued when final construction drawings relating to the foundation location, building height and exterior appearance are received and approved.  The drawings must be signed and dated by the property owner(s).  He further explained that the applicants are responsible for providing the Committee with the name, address and phone number of a contact person for the project.  Before pouring concrete, the Committee must receive written verification that the foundation location conforms to the approved Phase II application.  Before the top plates are placed, the Committee must received written verification that the building height conforms to the approved Phase II application.  The verifications must be made by an appropriately credentialed professional.  Gordon stated that the CC&Rs serve to protect the view from the living area, and because of the configuration of the house, future Committees may not be able to preserve the view.  Mr. Harper stated his understanding that the CC&Rs provide some protection for the view corridor.  Walt moved to grant a provisional permit.  Jim seconded and the motion passed 4-0. 

 

CONOVER 3/40 (43580 Sea Cypress Dr.):  Phase I application for New Home Construction permit.  Architect Glenn Coleman presented the application.  He explained that lots to the east and north are mostly on higher elevations and therefore their views to the southwest will not be impacted by the proposed project.  The northwest corner of the building envelope is configured in such a way as to maintain the ocean view of Dean and Patty Wolfe (9/49).  All minimum set backs are met.  Nik noted that the site plan lacks the source of the survey data and requested that it be included in the Phase II plans.  The Conovers confirmed that the 1990 septic permit is still valid.  Walt moved to approve the Phase I application as presented and with the source of the survey data indicated on the plans.  Jim seconded and the motion passed 4-0.

 

 

COMMUNICATIONS:

 

CONNER 1/063 (44000 Noyo Way):  8/10/05  Receipt of formal request for height and set back variances.  The ADC sent a notice to the affected neighbors on 9/12/05/05.  If no objections are received within 30 days, or 10/10/05, a provisional permit will be issued.

 

GORDON MOORES 1/95 (44001 Noyo Way):  8/18/05  Notification of intent of re-stain the office in a same color.

 

BUTERA 2/07 (44881 Arena Circle):  8/10/05  Receipt of formal request for height and set back variances.  The ADC sent a notice to the affected neighbors on 9/9/05/05.  If no objections are received within 30 days, or 10/7/05,  the variances will be approved.  The Butera’s approved application includes plans to excavate and install a drainage pipe on the neighboring lot, Ramirez (2/08).  A letter will be sent to Ramirez and copied to Butera explaining that the proposed work requires a permit and that the owner of record must make the application. 

 

BUTERA 2/07 (44881 Arena Circle):  8/11/05  Receipt of letter from Carl Rittiman stating that the septic design will be submitted to the County in the near future.  (See Minutes 7/23/05)  A provisional building permit will be issued when the ADC receives a copy of the approved County septic permit.

 

MOREALI 2/12 (44801 Pomo Lake Dr.)  7/31/05  Receipt of written verification that the foundation and height conform to the approved Phase II plans.

 

HEISLER 2/17 (44701 Pomo Lake Dr.):  9/27/05  Receipt of email regarding unauthorized tree removal on their lot.  The ADC does not have jurisdiction over trespassing or trees removal and these issues are usually resolved between neighbors and the County.  A letter will be sent to Ms. Heisler with information on how to contact her neighbor and the County Planning Department.  

 

HUMPHREYS/HYMANS 2/45 (15000 Mallo Pass Dr.)  8/25/05  Notification of intent to replace sunroom.  A permit is not required if there is no change to the footprint or external appearance of the house.


KUCALA 2/47 (14950 Mallo Pass Dr.):  9/14/05  Receipt of letter from William Moores requesting the Committee take action regarding the Kucala’s deck.  (See minutes of Sept. 18, 2004).  Nik suggested that Bill’s letter be forwarded to Mr. Kucala and that the Committee follow-up as well.  Bill Moores argued that Mr. Kucala has failed to remove the non-permited deck or submit plans for a new deck and suggested that the Committee pursue the issue in small claims court.  After discussion, the Committee decided to send another letter to the Kucalas requesting 1) notification of a date by which the subject portion of the existing deck will be removed, 2) plans for the new deck or modification, 3) projected completion date of construction.   

 

TRUJILLO 3/1 (14780 Cypress Point Road):  8/11/05   Receipt of written verification by Gerald Trujillo that the foundation location and building height conform to the approved Phase II plans.

 

COREY 3/10 (14640 Cypress Point Rd.):  9/14/05  Receipt of written verification from Virgil Knoche Construction that the foundation is located to conform to the approved Phase II plans.

 

HEMBEL 4/01 (15225 Forest View Rd.):  8/9/05  Receipt of notification of the completion of construction.

 

TIM MURRAY 4/10 (15441 Forest View Rd.)  7/26/05  Receipt of formal request for height and set back variances.  The ADC sent a notice to the affected neighbors on 8/4/05.  No objections were received and provisional permit number 0905-0410 was issued.

 

TIM MURRAY 4/10 (15441 Forest View Rd.)  9/3/05  Receipt of final construction drawings.  Final construction permit number 0905-0410 was issued with an expiration date of September 1, 2006.

 

MADSEN 4/21 (15631 Forest View Rd.)  9/12/05  Notification of intent to install a new roof of 50 year Prestique Plus in bark wood color.

 

MORTON 4/42 (15851 Forest View Rd.):  9/8/05  Receipt of written verification from Richard Seale, Licensed Surveyor, that the building height conforms to the approved Phase II plans.  Nik noted that the letter states the height above natural grade to be 15ft, which is impossible.  A letter will be sent requesting re-verification of the building height.

 

LAGERGREN 4/53 (15300 Forest View Rd):  8/25/05  Receipt of written verification from Paul Lagergren, Architect, that the foundation location and building height conform to the approved Phase II plans and receipt of the permit extension fee.  New Home Construction permit number 0804-0453 now expires on 11/21/05.

 

DECAMINADA 4/62 (15520 Forest View Rd.)  7/25/05  Notification of intent to install a shed on his property.  ADC has sent him information about obtaining a Minor Exterior Improvement permit. 

 

KEASBURY 4/64 (15570 Forest View Rd.)  8/26/05  Notification of intent to apply liquid siding to her home with a color change.  Color samples of brown and tan were submitted and approved.

 

O’DELL 7/05 (44560 Pomo Lake Dr.)  Notification of intent to replace a damaged portion of their roof. 

 

WM. MOORES 7/10  7/31/05:   Receipt of letter from MCP requesting information about the permitting process for a French drain installed by Wm. Moores.   A reading of the minutes of August 23, 2003 indicates that a permit for the subject French drain was issued pending the receipt of certain professional drawings.  The file contains a permit for the work with one signature.   Bill Moores indicated that he has the professionally prepared drawings and will provide a copy for the property file. 

 

GMEINER 7/23 (44370 O’Rorey’s Roost):  Receipt of letter from William Moores stating that Mr. Gmeiner’s construction has expired and requesting that the Committee take action.  Nik stated that the Committee is aware that Mr. Gmeiner’s permit is expired, as well as a number of others.  After discussion it was noted that the Committee is not on record as requesting third party delay documentation or extension fees.  A letter will be sent to Mr. Gmeiner documenting the date of issue of the permit and requesting documentation of any third party delays to construction.  The Committee will also request a completion date for the exterior construction.  

 

TRATHEN 7/26 (44400 & 44410 O’Rorey’s Roost):  7/24/05 Receipt of email from Dyson (7/25) regarding fire safety and the Trathens’ proposed garage.  Steve Whitaker requested and received a copy of the letter. 

 

TRATHEN 7/26 (44400 & 44410 O’Rorey’s Roost):  7/26/05 & 7/28/05  Receipt of emails from the Trathens regarding unauthorized stakes on their property.

 

TRATHEN 7/26 (44400 & 44410 O’Rorey’s Roost):  8/5/05  Receipt of revised topo map and notarized letter.  (See minutes, 7/23/05).  Major Exterior Modification Permit number 0705-0726 was issued with an expiration date of 1/22/07 for the construction of the garage.

 

TRATHEN 7/26 (44400 & 44410 O’Rorey’s Roost):  9/5/05  Receipt of letter from William Moores demanding that the Trathens’ Major Exterior Modification permit for a garage be revoked.  Bill Moores was present and argued that the Trathens had not fulfilled the conditions of approval of their application because their revised topographic map is based on the original topo map for the lot.  He argued that subsequent driveway excavation changed the topography, rendering the original topo inaccurate and making it impossible to determine if the proposed garage will exceed the 20ft height limit.  Gordon noted that the Trathens have made some changes to the submitted plans as a result of the Committee decision to recognize their building envelope at the 10ft set back line.  After discussion, the Committee concluded that they will follow up with the Trathens and request copies of the most recent drawings or changes to the approved plans. 

 

Bill Moores brought up the issue of trees on the property of Mark Gmeiner.  Nik explained that his concerns should be put in writing and will then be placed on the agenda.

 

UNFINISHED BUSINESS

 

LANDSBERG 2/25 (44860 Arena Circle):  Minor Exterior Improvement application for a propane tank enclosure.

KUCALA 2/47 (14950 Mallo Pass Dr.):  Issue of non-permited deck.

TRATHEN 7/26 & 27 (44400 & 44410 O’Rorey’s Roost):  Issue of non-permited fence.

PACKER 4/67 (15640  Forest View Rd):  Issue of absence of letter requesting extension due to National Guard Duty and no letter verifying height of structure.  Mr. Packer has submitted documentation of a delay related to military service of 545 days. 

BUCKE 4/18 (15601 Forest View Drive):  Issue of whether or not an after the fact permit extension is required.

FROMWILLER 4/68 (15700 Forest View Road):  12/20/04   Notification from Ms. Fromwiller that the installation of her propane tank, woodshed and fencing was completed on 10/9/04 and request for closure of her permit.

HUNOLT 7/11 (44500 O’Rorey’s Place):   No reply has been received to ADC letter of 9/18/04 regarding excavation on property.
